ClassMade LLC Inc. (“ClassMade LLC,” “we,” “us,” or “our”) created this Privacy Policy (“Privacy Policy”) because we know that you care about how information you provide to us is used and shared. This Privacy Policy relates to our information collection and use practices in connection with our online platform (the “Platform”), which is accessible through our website located at www.iClassMade.com and the related ClassMade App on Android, iPhone, and windows Platform.

The terms of this Privacy Policy are incorporated by reference in the Terms of Use that you accept upon registration for the Platform (the “Terms of Use”). By accepting the Terms of Use, you accept the terms of this Privacy Policy. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in the Terms of Use.

1. Safe Harbor Certification

In light of the international nature of our business, our privacy practices are self-certified to the Safe Harbor Program agreed to by the US Department of Commerce and the European Commission. We comply with the US-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. We have certified that we adhere to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. In compliance with the US-EU and US-Swiss Safe Harbor Principles, we commit to resolve complaints about your privacy and our collection or use of your Personal Information. European Union or Swiss citizens with inquiries or complaints regarding this Privacy Policy should first contact us via e-mail at: service@iClassMade.com with “PRIVACY POLICY - SAFE HARBOR” in the subject line. We have committed to refer unresolved privacy complaints under the US-EU and US-Swiss Safe Harbor Principles to an independent dispute resolution mechanism, the BBB EU SAFE HARBOR, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed by us, please visit the BBB EU SAFE HARBOR web site at www.bbb.org/us/safe-harbor-complaints for more information and to file a complaint.

2. Information We Collect

When you sign up to become a Registered User, you will be asked to provide us with certain personal information, such as your name, user id, email address, phone number(s), gender, location, date of birth, profile photograph and networks. In this Privacy Policy, we refer to this information and any other personal information provided by you as “Personal Information.”

By becoming a Registered User, you agree that your name, user id, location and profile photograph will be publicly visible. We use your date of birth to ensure you meet the age requirements for the platform and to show you age-appropriate content.

In addition, any information that you, your friends or others submit on the Website or App, will be accessible by those Registered Users that the account holder of posts/chats has permitted to view . Any information that you, your friends or others provide on public forums may be visible to all Registered Users and to the world at large. You acknowledge and agree that (a) any Personal Information made available through a Private chat or Public forums becomes public information; (b) we cannot control what viewers do with that information; and (c) this Privacy Policy does not apply to use by other viewers of such information. More specifically, the contact information of registered users are visible only to friends, classmates, and members of clubs that the users enrolled. Private chats are only visible to chat participants. Public forum posts are visible to the public.

3. Use of Cookies

We use automatic data collection technology when you use the Platform to record information that identifies your computer, to track your use of the Platform, and to collect information about your usage habits. This information includes information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages or content, what sections of the Platform (including Mags) you visit and similar information concerning your use of the Platform (the “Usage Information”). We collect this Usage Information by using cookies. Cookies are small packets of data that a web site stores on your computer’s hard drive so that your computer will “remember” information about your visit. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) and other technologies to help us collect Usage Information and to enhance your experience using the Platform.

We may use cookies for various purposes, including:

  • To help you navigate our Platform;
  • To facilitate the sign up and login process for our Platform;
  • To personalize your experience;
  • To analyze which pages are visited most frequently;
  • To provide features such as social sharing widgets and videos; and
  • To measure advertising and promotional effectiveness.

Click here to view a list of any third party cookies being used on the platform and to see a description of the kind of information they are collecting. We may update this list from time to time so it is a good idea to check the list regularly.

If you do not want us to deploy cookies in your browser, you can opt out by setting your browser to reject cookies or to notify you when a web site tries to put a cookie in your browser software. If you reject cookies, you may still use the Platform, but may not be able to use some areas of Platform. We do not collect Personal Information in this way, but if you’ve provided us with Personal Information we may associate that information with the information that is collected automatically. Automatic data collection may be performed on our behalf by our services providers.

4. Public Analytics Data

We track your Usage Information and activity in, to and between, Public posts (“Public Posts Usage Information”) unless you select not to be tracked. If you select not to be tracked, (a) we may charge you a fee to use the Platform, and (b) you will not be able to access certain features and areas of the Platform. We do not track any usage activity in Private chats, and in no event will any Private chats usage activity be shared or sold, in the aggregate or any other form, with any third party, except as expressly set forth in this Privacy Policy

5. Geolocational Information

In order to use the Platform, we may, with your prior permission, collect geolocational information from your mobile device, your wireless carrier, or certain third-party service providers (“Geolocational Information”). Collection of such Geolocational Information occurs only when the Platform is running on your mobile device. You may decline to allow us to collect such Geolocational Information, in which case we will not be able to provide certain services to you. Because your Geolocational Information is subject to abuse by others, please be sure to manage your mobile device and privacy preferences on the Platform on an ongoing basis.

6. Use of Your Information

We will use your Personal Information and Usage Information for the following purposes:

  • To respond to your requests and to provide you with the Platform;
  • To respond to your inquiries and contact you about changes to the Platform;
  • To send you notices (for example, in the form of e-mails, mailings, and the like) regarding the Platform and for billing and collection purposes;
  • To improve the Platform;
  • For any other purposes disclosed at the time the information is collected or to which you consent; and
  • As otherwise specifically described in this Privacy Policy.

We may aggregate your gender, location, date of birth and/or Public Posts Usage Information with similar Personal Information and/or Public Posts Usage Information of other Registered Users and share and/or sell that information in an anonymous, aggregated manner, with our customers and business partners.

We, like many businesses, sometimes hire other companies to perform certain business-related functions. Examples include mailing information, maintaining databases, hosting services, and processing payments. When we employ another company to perform a function of this nature, we provide them with the information that they need to perform their specific function, which may include Personal Information.

If we or all or substantially all of our assets are acquired, we expect that the information that we have collected, including Personal Information, would be transferred along with our other business assets. We will use commercially reasonable efforts to ensure that the purchaser of our assets will use such information in accordance with this Privacy Policy.

We may disclose user information to government authorities, and to other third parties when compelled to do so by government authorities, at our discretion, or otherwise as required by law, including but not limited to in response to court orders and subpoenas. We also may disclose user information when we have reason to believe that someone is or may be causing injury to or interference with our rights or property, other users of the Platform, or anyone else that could be harmed by such activities.

7. How We Protect Your Information

We take commercially reasonable steps to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail or posts sent to or from us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail or posts.

8. Accessing and Modifying Account Information

You may update your Personal Information through your account settings. You may delete Personal Information that you have included in posts on your or other posts by deleting that specific post You may also delete any Personal Information that other persons have included on your post by deleting that specific post. To delete Personal Information that other parties have put on other posts, contact the post owner to request that they delete the information. Otherwise, you can report the relevant content to us by email and log the relevant report request through the Platform. We will use commercially reasonable efforts to delete that information from our databases; there may be a short time delay before any post deletion requests take effect.

If you wish to stop receiving e-mails from us, please unsubscribe by following the instructions in the bottom of the email.

10. Links

The Platform may contain User Generated Content that links to External Sites. We do not endorse these External Sites and we are not responsible for the privacy practices of any External Site. Please refer to the privacy policies of the External Sites for more information on how the operators of those sites collect and use your Personal Information.

11. Children

Children under 14 years of age may only access the Platform through a Nest Account that is managed by a parent or legal guardian. We will collect Personal Information relating to children under the age of 14 if they are the beneficiary of a Nest Account. All information relating to a beneficiary of a Nest Account is to be provided by the parent or legal guardian managing the Nest Account. Each parent or legal guardian who creates a Nest Account for a child acknowledges that by doing so such parent or legal guardian is (a) permitting the child to upload content, such as photos, videos and/or audio recordings of themselves and/or other children; (b) approving collection of Geolocation Information related to the child; and (c) allowing the child’s Personal Information to be used by recommend appropriate content to the child when the child is in the navigations zones of the Platform. We strongly encourage parents and legal guardians to monitor their child’s internet usage and to help enforce our Privacy Policy by instructing the child to never provide Personal Information through any website or App without their permission.

If you have reason to believe that a child under the age of 14 has provided Personal Information on a Public post, you can report the relevant content to us by sending us an email and log the relevant report request through the Platform and we will use commercially reasonable efforts to delete that information from our databases; there may be a short time delay before any deletion requests take effect.

Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time, and will notify you of any changes during your next log-in to your account. You will be required to affirmatively accept these changes prior to logging-in to your account.
